This is a translation. The Danish version is the legally binding text. If the two differ, the Danish wording prevails.

These are the rules for using our software: Project OSIS and its modules, Sailing Log, the client portal and beyondvision.dk. They cover what you may and may not do as a user. The commercial terms are under Sales and refunds, the handling of your data under the privacy policy, and the corporate framework under Legal.

01. Who this applies to

These terms apply to everyone using our systems — however they came to be in them:

  • The customer is the club, boarding school, institution or organiser holding the licence. The customer also has a licence agreement with us, and that runs to more than this page.
  • The user is you, logging in: administrator, coach, instructor, judge, student, participant, parent or sailor. You do not have to have signed anything — the terms apply from the moment you use the system.

If you came in through your school, club or organiser, their rules apply too. Where those are stricter than ours, theirs are what count.

Which document takes precedence

Where the documents conflict, they apply in this order:

  1. A signed agreement or contract between the customer and Beyond Vision
  2. The data processing agreement
  3. Legal information
  4. Sales and refunds
  5. These terms of use

02. Acceptance & age limit

By accessing, downloading, installing or using our software you accept these terms. If you cannot accept them, you must not use the systems — and we would ask you to say so to whoever gave you access.

Age limit

  • You must be at least 13 to create a personal account yourself.
  • If you are under 18, your parents or guardians must agree to your using the service.
  • Accounts created centrally by a school, club or organiser — student accounts at a boarding school, for instance — are not covered by the age limit in the same way. There the institution handles the creation and the consent, under a data processing agreement with us.

If we discover an account was created by a child under 13 outside an institution, we close it and delete the data.

03. Your account

Your account is personal. You are responsible for what happens on it.

  • Keep your password to yourself. Do not share it, not with a teammate, not with a colleague, and not with someone who "just needs to look at something".
  • Use a password you do not use anywhere else. If two-factor authentication is available, turn it on — for administrator accounts we expect it.
  • You are liable for actions taken with your login, unless you can make it plausible that it was not you, and that you told us as soon as you noticed.
  • Tell us immediately if you suspect someone has got hold of your access: kontakt@beyondvision.dk. It is not embarrassing — it is useful.
  • Your details must be correct. Do not create accounts in someone else's name, and do not invent an identity.
  • One account per person. Accounts must not be transferred, sold or reused by whoever takes over the job — ask the administrator to create a new one instead.

Administrators at the customer are responsible for removing access when an employee, coach or volunteer leaves. We cannot see who has stopped at your organisation.

04. Conduct

Most of this is common sense. We are writing it down anyway, so it is clear what gets an account closed.

You must not

  • Attempt to gain access to accounts, data or parts of the system you have not been given access to.
  • Test, scan or attack our systems without an agreement. If you want to help find holes, the procedure is under Responsible Disclosure in Legal — that route is welcome.
  • Clone, copy, emulate or manipulate NFC cards and wristbands, or otherwise cheat the access control.
  • Tamper with results, points, times, registrations or statistics — your own or anyone else's.
  • Put illegal, threatening, harassing, hateful or sexualised content into the systems. There are children and young people among our customers.
  • Upload photos or video of other people without their consent — or their parents', if they are under 18.
  • Upload material you do not hold the rights to.
  • Send spam, chain letters or marketing through the systems.
  • Upload files containing malware, or try to make the system run code it should not run.
  • Scrape, crawl or automatically harvest data from the systems or our APIs.
  • Reverse engineer, decompile or circumvent licence and access restrictions, beyond what mandatory law permits.
  • Load the system unnecessarily — for example with automated calls at a rate no human user would produce.
  • Use the system to monitor people contrary to the law, including the rules on CCTV and on monitoring employees.

Common sense during an event

If you are helping run a competition or a camp, one more thing: do not change the setup in the middle of the event unless you know exactly what you are doing. Call us instead. We will take it with you.

05. Your content

What you put in — text, photos, video, announcements, participant data, results, logbooks — is yours, or the customer's. We do not take ownership.

We get the licence needed to run the service: to store the content, display it where you have chosen, take backups, convert formats and compress it. No more than that. The licence ends when the content is deleted or the agreement expires. If we want to use any of it in our own marketing, we ask first.

In return, you warrant that you are allowed to put it in: that you hold the rights, and that the people appearing in the images have agreed.

We can remove content. If something is illegal, abusive or in breach of section 04, we can remove it — without asking first, if there is a risk of harm to someone. We always tell the customer what we removed and why.

06. Screens & public display

Information screens and big screens hang in public space. Anything put on them can be seen by everyone passing — including parents, guests, opponents and the press photographer.

  • The customer decides what is shown and is responsible for the content. We do not vet it continuously.
  • Do not display information that cannot bear being public: health, allergies, medication, grades, social circumstances, home addresses or phone numbers of minors.
  • Name, group, running order and results are usually fine to show at an event — but use judgement, and leave it out if a participant has asked to stay anonymous.
  • If the screen is to show photographs of participants, consent must be in place. See Legal, section 05.
  • If the screen runs with sound in a room, remember that copyright in music applies on an information screen too.

07. Competitions, judging & results

OSIS calculates, displays and stores. People do the judging.

  • Marks, points and placings are entered by judges and officials. The system totals them according to the rule set the organiser has chosen.
  • The official result is the one the organiser or the judging panel approves — not necessarily what was on the screen the second before.
  • Live displays, leaderboards and stream overlays are provisional until the organiser has approved the result.
  • Complaints about a result, a decision or a placing must go to the organiser. We cannot change a competition's results, and we do not do so without written word from the organiser.
  • If a technical fault arises along the way, we help reconstruct the data as far as we can. The organiser should always have a manual plan B — pen and paper have never let anyone down.

08. Access cards & NFC wristbands

  • The card or wristband is personal and must not be lent, swapped or sold on.
  • If you lose it, tell the organiser at once so it can be blocked. Until then, whoever finds it can use it.
  • Attempts at cloning, emulation or manipulation lead to immediate blocking and removal from the event — and may be a criminal offence.
  • A wristband grants access to what the organiser has granted it access to. It is not proof of payment, membership or age.
  • If a deposit has been taken for a card, it is settled under the organiser's rules, not ours.
  • When and where a scan happens is logged. The privacy policy says for how long.

09. Buying at the kiosk

If you buy something through OSIS Payment Suite, the seller is the organiser or the club — not Beyond Vision. We supply the till system, and the payment is carried out by our payment partner SumUp.

  • Receipts, refunds, exchanges and complaints are handled by whoever sold the goods.
  • We never see your card details. They are handled inside the payment provider's own environment.
  • If an item has an age restriction, the staff at the kiosk check it. The system can prompt them, but it is not a check.

10. Sailing Log

The app is not approved navigation equipment. It does not replace charts, a plotter or notices to mariners, and it must not be used for emergency communication. In distress at sea: VHF channel 16, or phone 112. Every disclaimer is gathered in Legal, section 10 — read them before you cast off.

How to behave in the app

  • Do not share other people's positions, photos or boat details without asking them.
  • Do not write things in your logbook notes that you would not stand behind. Why that is worth knowing is in the privacy policy.
  • Do not fake nautical miles, routes or voyages to climb the leaderboard. It is a leaderboard for sailors, not for the creative.
  • If you are using a different boat or sailing as crew, log it as what it is.
  • Your live position is visible to other users by default. You can switch to friends only or turn it off entirely in settings — and you ought to know which you have chosen.

We may remove obviously invented voyages from the leaderboard if they spoil it for everyone else.

Purchases in the app

Subscriptions and purchases are handled by Apple and Google. Cancellation and refunds go through your Apple or Google account. See Sales and refunds.

11. The client portal

Access to the client portal is reserved for customers with an active licence agreement and the people the customer has given access.

  • Material in the portal — guides, configurations, prices, contracts — is confidential and must not be shared outside the organisation.
  • The customer keeps track of who has access and removes access that is no longer needed.
  • If the licence agreement ends, access is closed. What happens to your data is set out in Legal, section 05.

12. Operations, uptime & liability

The services are provided "as is". We take care, but we do not promise there will never be a fault or never be downtime.

  • We aim for 99.5% uptime per month on our own services. Current status is on the status page.
  • Planned maintenance is announced and scheduled outside normal working hours. Critical security updates may come without notice.
  • Support is available on weekdays 9–17. During agreed events there is extended cover.
  • Parts of the systems depend on third parties — Google, Apple, SumUp, KMD, weather data and your own network. If they go down, we go with them.
  • If you use your own equipment — your own screens, your own phones for NFC scanning, your own network — running that is your responsibility.

The limitation of liability, the financial cap and the force majeure rules are gathered in Legal, section 09 and apply to these terms as well.

13. Suspension & closure

We may restrict, suspend or close access if:

  • there is a genuine suspicion of a breach of section 04,
  • the access is being used in a way that threatens other people's data or our operations,
  • the customer has not paid, per Legal, section 06, or
  • we are ordered to by an authority.

As a rule we contact the customer first and ask for the matter to be put right. If there is danger, we close first and explain afterwards — but we always explain.

If you want to close your account yourself, you can do so inside the app under settings, or write to us. If your account was created by a school or club, go to them — it is their system, not ours.

On closure your data is deleted or anonymised according to the periods in the privacy policy. Some of it we have to keep longer, because the Danish Bookkeeping Act requires it.

14. Changes, governing law & complaints

Changes

We update these terms when the systems, the law or our practice change. Material changes are notified to active customers by email at least 30 days in advance. If you keep using the services after they take effect, the new version applies. If you do not want to accept it, you can close your account — and if you are a customer, you can terminate the agreement as of the effective date at no charge.

Governing law and venue

Danish law. The venue is the district court in Næstved, unless mandatory rules say otherwise — if you are a consumer, you can always bring proceedings at your own domicile.
